Today a Judge has overturned the conviction of a Christian street preacher who was arrested and reported to Prevent for ‘misgendering’ a member of the public. 

Supported by the Christian Legal Centre, Dave McConnell, 42, from Wakefield, was appealing a conviction today at Leeds Crown Court after he was arrested under section 4A Public Order Act 1986 for ‘insulting’ a member of the public in Leeds City Centre on 8 June 2021.

The arrest was made after he ‘misgendered’ a biological male who self-identified as a ‘trans woman’ during a one-on-one conversation with a police officer who was covered in pagan tattoos and an upside-down cross

Prior to the arrest, Mr McConnell had been assaulted, abused and had his belongings stolen while he was preaching. 

Mr McConnell was subsequently convicted at the Magistrates Court, made to pay costs of £620 and forced to do 80 hours of community service despite there being no legal obligation to use a trans person’s preferred pronouns in the UK.

Following his conviction, and prior to the sentencing hearing, the Probation Service reported Mr McConnell to the Joint Counter-Terrorism Team. 

The report was made despite the probation officer concluding that it was clear that Mr McConnell’s Christian faith had positively impacted his life.

It is believed Mr McConnell is the first street preacher to be convicted for such an offence and reported as a potential ‘terrorist.’

Before Recorder Anthony Hawks and two magistrates, Mr McConnell’s lawyer, Michael Phillips, today sought to overturn the conviction by arguing that the police response was unlawful, disproportionate and interfered with his Article 9 and 10 rights under the European Convention on Human Rights (ECHR).

“I wasn’t misgendering, I was telling the truth”

At the start of the hearing and before cross-examination, Recorder Hawks said of the complainant, who is a biological male who self-identifies as a ‘trans woman’: “This is a woman, we will have no more debate.”

During proceedings, the arresting officer was asked why he had arrested Mr McConnell after initially suggesting that he just move on. The officer said: ‘He wanted to argue his rights of free speech. Regardless of what he’d have preached, I think the crowd wouldn’t allow it…the final trigger was when [Mr McConnell] referred to the victim as a man in a dress. I stopped him and told him he’d been told victim was a female.’

Mr McConnell was asked in court whether he knew that ‘misgendering’ a trans person could be insulting, to which he replied: “I wasn’t misgendering, I was telling the truth.”

He told the court: “I think people could have been offended but that’s not the intention. My intention was to simply stay faithful to my beliefs, stay faithful to God and to stay faithful to my conscience.”

He added: “I wasn’t being transphobic; I was expressing what I believe.”

Before he had finished giving evidence, the Bench retired and found that the Crown had not proved their case, the court ruled Mr McConnell had not intended to cause the complainant ‘distress’,  Recorder Hawks allowed the appeal and therefore overturned the conviction. 

Recorder Hawks said that Mr McConnell ‘misgendering’ the complainant did cause the complainant distress but ‘it is not an offence to insult someone.’

Furthermore he said that under the Public Order Act ‘it is not enough to show words were insulting and that [the complainant] was distressed. They must prove that we as a bench are sure that when [Mr McConnell] was using those words that he intended to cause distress. 

[Mr McConnell] said he had no such intent, he says he goes out preaching the Word of God and the last thing he wants to do is upset. He said he was not intending distress, just repeating what he genuinely believed to be the Bible’s teaching.’

He concluded saying: “We live in a time of free speech.”

‘I was telling the truth’

Following the ruling, Mr McConnell said: “I am delighted and relieved that the Judge has overturned the conviction and that I can clear my name. I am, however, appalled at how I have been treated by the authorities in this matter. No other street preacher, professional or member of the public must go through what I have. 

“‘Misgendering’ is not a crime and should never be treated as such. I do not believe I was ‘misgendering’, I believed I was telling the truth. 

“How I was treated was totally unreasonable and should concern anyone who cares about Christian freedoms and free speech in this country.  

“Jesus told Christians to expect persecution, however, and I am determined to continue my ministry as while there is always opposition, I also see many people positively impacted.  

“Jesus changed my life as a young man, and I am passionate about engaging people with the hope that made such a difference to me.”

Andrea Williams, chief executive of the Christian Legal Centre, who backed McConnell’s case, said: “Dave McConnell has been vindicated and we are pleased that the Recorder has seen sense. No one should go through what he has for stating biological fact. 

“This case has represented a disturbing trend in our society which is seeing members of the public and professionals being prosecuted and reported as potential terrorists for refusing to celebrate and approve LGBTQ ideology.

“Police forces who fly pride flags from their headquarters are failing to provide Christian preachers with impartial protection. If a person cries ‘’offence’ at a street preacher’s words, it’s the street preacher that is punished and taken out. This is deeply illiberal.
 
“The bible teaches clearly that we are born male and female; this belief and the freedom to express it in public without fear of being arrested or reported as a terrorist to Prevent must be protected.

“Dave is a kind and caring man, who loves Jesus, and wants members of the public to know about the truth of the Christian faith which has transformed his life.”

Toby Young, General Secretary of the Free Speech Union and Executive Director of Sex Matters, Maya Forstater, submitted expert reports in support of Mr McConnell’s case. 

‘This gentleman’

A born-again Christian, Mr McConnell has been street preaching across Northern England for 15 years and has a powerful human interest testimony. 

The aim for his street preaching is to share the Bible’s message that we have all sinned by disobeying God’s laws. He preaches that the Gospel is good news and that by believing in Jesus Christ, we receive forgiveness of all our sins, and can have an assurance of eternity in heaven. He believes the foundational Christian belief from Genesis 1: 27 that we are born male and female.

While preaching on 8 June 2021 in Briggate, Leeds, a pedestrianised area of the city, Mr McConnell was asked, while speaking about a range of topics, by a biological male that self-identified as a ‘trans woman’ whether God accepted the LGBT community.

Responding to the question, Mr McConnell, who encourages members of the public to ask him questions while preaching, said: “No, God hates sin. So, this Gentleman asked a question…”

Members of the crowd screamed at him: “She’s a woman!”

Mr McConnell replied: “No, this is a man”, to which a female member of the crowd shouted: “She’s just as much a woman as me!”

Continuing to calmly preach about what the Bible says about sexual sin and homosexuality, Mr McConnell referred to the individual as ‘this gentleman’ and a ‘man in women’s clothes.’

Video footage revealed Mr McConnell continuing to preach and during the afternoon and was repeatedly verbally abused by members of the public, assaulted, and at one point had possessions stolen, including an amplifier.

Members of the crowd, which included a part-time drag queen, had grown to over 100 and chanted ‘Hate speech, Hate Speech’ when the police arrived on the scene.

Video footage revealed members of the crowd shouting at the police: “You’ve got a baton, slap him around the f***ing arse and take him.”

They also called Mr McConnell, and another street preacher standing alongside him, a ‘Stupid C***’ a “dirty little scumbag” and said “just imagine if I pushed him off there [step ladders].’

The crowd also shouted at the preachers to: “Turn that cross upside down and shove it up you’re f***ing arse.”

Arrest

Rather than controlling the crowd, a police officer with pentagram tattoos started collating evidence on how Mr McConnell had allegedly ‘misgendered’ the ‘trans woman’.

The officer began a one-on-one conversation with Mr McConnell where he suggested that they would not arrest him, but would invite him for an interview at the police station at a later date.

Asked what the allegations were against Mr McConnell, the officer said: “Homophobic hate crime. Officers say that there are a lot of members of the crowd who are ‘harassed, alarmed and distressed’.

The officer was referring to Section 5 of the Public Order Act, which is often weaponised by members of the public to compel the police to take action against anyone who is ‘offending’ them or who they feel is causing ‘harassment, alarm or distress.’

Mr McConnell said: “I know I have not violated any law” and added that “the person who came up was a man in women’s clothes.”

Following this comment, the officer aggressively stepped towards Mr McConnell and said: “Listen mate, I’m not having that, because she’s told you she’s a woman.”

Under pressure, McConnell then said: “She asked me, he asked me what do I think…”, but the officer cut him off, took out handcuffs and said: “Ok, you’re under arrest”. The officer said he was being arrested ‘Contrary to Section 4A(1) and (5) of the Public Order Act 1986’, and to ‘prevent further harm to others.’

With the crowd cheering, Mr McConnell was then led away to a police van. Held in custody for 14 hours, he was charged and then released.

Conviction

At the Magistrates Court, he was convicted by the local district judge and was sentenced at a hearing in August 2022 to a 12-month community order, involving humiliating community service with 80 hours unpaid work, and fined.

Commenting on the case, Elizabeth Wright, from the Crown Prosecution Service (CPS), said: ‘People have the right to hold opinions and express their views. But when words cross the line between a legitimate expression of religious views, and become distressing and threatening, the CPS will prosecute offenders if our legal test is met.’

Report to counter-terrorism

Following his conviction, and prior to the sentencing hearing, the Probation Service ‘routinely’ reported Mr McConnell to counter-terrorism. 

The probation officer’s report said that it was clear that Mr McConnell’s Christian faith had positively impacted his life and helped him become a ‘hard working family man.’ It continued that: “I am satisfied there is no sinister or deliberately offensive objective to Mr McConnell’s activities.”

Yet the report concluded saying:

“As with any adjournment where the individual is viewed to be persistently and illegally espousing an extreme point of view, I have routinely liaised with my colleagues in the Joint Counter Terrorism Team. They have no further information on Mr McConnell that would suggest their intervention would be likely or helpful.”

Mr McConnell’s win follows a similar case in December 2022 involving street preacher John Dunn. After the Crown Prosecution Service (CPS) put in their legal arguments that parts of the bible ‘are no longer appropriate in modern society’, the government was forced to make a statement clarifying that it was in fact ‘inappropriate’ for the CPS to make such a suggestion.

[2] ‘Fatherlessness — Not Racism — Is Number One Problem in the US,’ Say Black Leaders

The Black Conservative Summit (BCS), March 24-25, casts a spotlight on America’s ‘crisis’ of ‘lack of fathers in the home,’ while honoring heroes in the movement committed to building strong families and communities – including Bob Woodson, Ken Blackwell, Dr. Shelby Steele, and Kay Cole James.

CHICAGO — Popular radio talk show host Larry Elder says fatherlessness — not racism — is the biggest problem facing the Black community and wider America.

His remarks come before the start of the fifth annual Black Conservative Summit — convening the largest gathering of influential Black leaders in the Midwest — in the Chicagoland area, March 24-25. Registration for the Summit is open to the public and the working press.

Seven out of every ten Black American children are born to an unmarried mother, according to Elder, who will be joined at the BCS by fellow cast members of Uncle Tom II: An American Odyssey, and a multi-ethnic group of U.S. conservative leaders, including four heroes of the movement being honored with the coveted R.I.S.E Award during closing ceremonies.

In Illinois last year, approximately 278,000 Black children — a whopping 72% — lived in a home without a father, compared with 40% of Hispanic children and 23% of White children, according to America’s First Policy Institute.

Several years ago, former President Obama also spotlighted the nation’s fatherlessness dilemma, telling a Chicago church congregation – located just 20 miles from where the Summit will be held at the Tinley Park Convention Center in two weeks – that “a child raised without a father is five times more likely to be poor and commit crimes, nine times more likely to drop out of school, and twenty times more likely to end up behind bars.”

‘Traditional Family Values Under Attack’

“The traditional, nuclear family in the U.S. is under attack from an extreme liberal agenda,” said Dr. Eric Wallace, co-founder of Freedom’s Journal Institute, a faith-based non-profit. At the summit, Wallace and his wife, Jennifer, director of Black Families Matter, will explore the “crisis” facing America’s families.

Like many Black conservatives, the Wallaces, who organized the first Black Conservative Summit in 2013, cite issues such as Critical Race Theory (CRT), Black Lives Matter (BLM), and the promotion of unrestricted abortion and gender fluidity as major threats to the traditional family — and the cause of many problems facing Black communities.

In 1965, the number of Black children born out of wedlock was only twenty-five percent. Unlike the narrative of their liberal counterparts, conservatives assert that the number skyrocketed when the U.S. welfare system ballooned.

“Many of the problems facing the Black community in America — including high crime and incarceration rates — stem not from racism; but from the rise of welfare and the disintegration of the traditional ‘nuclear’ family,” said Bob Woodson, founder of the Woodson Center, a non-profit organization, which promotes the economic revitalization of urban neighborhoods.

Woodson and conservative leaders, including The Honorable J. Kenneth Blackwell, chairman of the AFPI Center for Election Integrity; Dr. Shelby Steele, Robert J. and Marion E. Oster Sr. Fellow, Hoover Institution; and The Honorable Kay Cole James, secretary of the Commonwealth of Virginia, will be presented with awards at the Summit for their outstanding impact on and commitment to strengthening communities and families.

“Our earnest conviction is that many of the Black communities’ problems, as well as problems and struggles of other communities, could be solved if we gave more attention to building strong and healthy families,” Jennifer Wallace said.

[3] ‘Diversity Takes Precedence over Religion’ Says UK National Health Service Boss as Chaplain Ousted for Same-Sex Marriage Beliefs Takes Legal Action

A Catholic chaplain and former professor of neurosciences is taking legal action against an NHS trust after he was ousted for answering a patient’s questions about the Church’s teaching on marriage.

In a letter written in response to the patients’ subsequent complaint, the Acting Chief Executive of South West London and St George’s Mental Health NHS Trust, Vanessa Ford, stated that the Trust’s policy on Equality and Diversity ‘takes precedence over religious belief.’

Supported by the Christian Legal Centre, Rev. Dr Patrick Pullicino, 73, is pursuing a claim against the Trust for harassment, religious discrimination, and victimisation against the Trust. The trial is set to take place in July 2023 at Croydon Employment Tribunal.

Rev Dr Pullicino has had a distinguished career in the NHS as a Consultant Neurologist until being ordained as a Catholic priest in 2019.

He is best known as one of the few doctors who first raised the alarm in 2012 over the abuses carried out under the Liverpool Care Pathway, an end-of-life protocol abolished two years later.

Catholic teaching

On the 20 August 2019, Rev. Pullicino was assigned to visit a male patient on one of the hospital’s mental health wards who had specifically requested to see a Catholic chaplain.

The patient requested that they go for a walk outside, which they did accompanied by one other member of staff.

During the 20-minute conversation, the patient said that he was in a same-sex relationship and that he wanted to marry his partner which he said he could now do legally. He asked Rev. Pullicino what his opinion was as a Catholic priest.

Rev. Pullicino responded saying: “What do you think God would say to you about this?”

The patient went on to say that his father had cut off from him and was at odds because he was upset by his way of life. He asked for the priest’s advice. 

Rev. Pullicino said that in the same situation he might be upset too and that it was important to have the support of his family and encouraged him to see the situation from his father’s point of view.

Each of Rev. Pullicino’s responses were pastorally appropriate expressions of the teaching of the Catholic Church.

Complaint

Returning to the ward the following day, Rev. Pullicino was met by another member of staff who told him he could not enter as a complaint had been lodged against him.

Rev. Pullicino was then asked to attend a meeting with the Head Chaplain of the Trust, where he was not properly informed of the nature of the complaint.

Throughout the meeting it was impressed upon him that he had to adhere to the Trust’s Equality and Diversity policy to avoid future complaints and that he would have to retake his diversity training.

Following the meeting, Rev. Pullicino was sent an email confirming what had been discussed, with an added comment, which had not been raised in the meeting, which said:

NHS policy on Equality and Diversity in relation to the complaint supersedes religious standing whilst working and representing the trust’.

In response, Rev. Pullicino sought clarification on whether there had been a formal complaint made against him and whether an investigation had been launched.

On the 17 September 2019 he was told in a letter from the Head Chaplain that:

“The complaint we discussed in our meeting on Tuesday is a formal complaint and as a matter of Trust policy this will be retained and kept on a central record for complaints. The meeting between us to discuss the complaint is a sufficient outcome provided the actions and discussion we had is carried out. As a result there is no right of appeal as there is no “decision” to appeal.”

Unknown to Rev. Pullicino, however, two days later, the Acting Chief Executive for the Trust, Vanessa Ford, responded to the patients’ complaint.

In it, Vanessa Ward asserted that the Trust had in fact launched a formal investigation under its complaint’s procedure. 

Ms Ward repeatedly apologised to the patient for the alleged comments and said that Rev. Pullicino’s supervisor would: “ensure that he understands the Trust policy on Equality and Diversity and that this takes precedence over religious beliefs”, a comment inconsistent with what the Equality Act 2010 states.

Rev. Pullicino was first made aware of the contents of this letter at a meeting with the pastoral team leads. They told him that the complaint had been resolved informally, but again insisted that he must take an equality and diversity course.

When Rev. Pullicino wrote to the pastoral team that he intended to resume his duties on the ward as the patient was no longer there, he was told that his correspondence had shown: ‘no evidence of your acceptance and reflection on the fact that your comments went against all our Trust Values and Behaviours’.

It was also demanded: ‘Can you please record in writing that you accept that your comments went against Trust values and behaviours and have reflected on this in your supervision along with assurance that you have learnt from this incident’. The email concluded, ‘Only when I have assurance that such incidents will not reoccur can we look at you visiting wards again’.

Rev. Pullicino agreed that out of goodwill he would take the course under the condition that it was recognised that he had not been ‘homophobic’ to the patient.

‘You have no rights’

However, Rev. Pullicino was told by the Head of Therapies at the Trust that he did not have any rights because he was a temporary member of staff and that his contract could be terminated at any moment without notice.

Just before Christmas, and while on annual leave, Rev. Pullicino received an email from the Head Chaplain that he was to return his ID badge immediately and that: “from the 15th January 2020 the Trust is unable to pay for your services any longer due to the budgetary constraint.”

On 29 January 2020, Rev. Pullicino responded saying he was happy to work without pay and returned his ID badge. In response he received an email stating:

“Thank you for handing back your ID. As you are already aware the Temporary Staffing has removed you from the system and due this your IT access is not valid anymore. I need you to know that you are currently not authorised to visit the wards or saying mass [sic] as you are not currently under any terms and conditions or insurance. This will stand until and unless we have agreed in writing for you to have an on-going role in the Trust.”

In a pre-action letter to the Trust, Christian Legal Centre lawyers have argued that the reason for ending Rev. Pullicino’s role at the Trust has nothing to do with budgetary cuts as his pay was very low and he was the only Catholic chaplain on site.

‘Christian beliefs silenced and eradicated’

Rev. Pullicino said: “I am determined to seek justice in this case as how I was treated was unacceptable. To see in black and white that my Christian beliefs in marriage, that have been taught for thousands of years, are not on a par with equality and diversity, was shocking.

“I was bullied, forced into a corner and told that I had no rights and therefore could be thrown out following one complaint.

“I believe NHS hierarchy capitulated and were not prepared to tolerate having a chaplain on site who would not affirm what the Catholic church teaches to be sin.

“There does not appear to be a place for Christian teaching or belief in the NHS. In a truly democratic society where all faiths and beliefs are respected, I would not have been treated as I was.

“I hope my case sends a message to the NHS that true equality and diversity includes Christian teaching and beliefs.

“My case is not an isolated one, there are many Christian chaplains and chaplaincy, not just in the NHS but across institutions whose beliefs are being silenced or forced out entirely. I am taking this stand as I do not want anyone else to go through what I have.”

Self-censorship

Andrea Williams, chief executive of the Christian Legal Centre, said: “How many more of these cases do we need before society wakes up? We need to see an end to the ideology of equality and diversity riding roughshod over the Christian faith and treating it with such little respect.

“Christian Chaplaincies provide the good news stories and places of safety in so many of our institutions. They should be treated with the respect they deserve. It’s time to end this kind of attack on them.

“This story is one in a long line of stories that sends a chilling message to NHS chaplains that you can no longer respond to questions on human sexuality with standard biblical teaching. You must self-censor, affirm at all costs, or face the consequences. We are acting to say that this has to end and will end.”

Texas is one of the “red” (Republican) states that citizens of more leftist-dominated states are relocating to, but the following report proves that the problem is not in politics, it is in the school house. As long as the public schools are humanist, leftist, homosexualized propaganda institutions, it is only a matter of time when the Old America will be no more. Austin Independent School District’s academic year ends on May 25, though, which means it loses out on the opportunity to groom the children in its care at that time. The following is excerpted from “The Covid mask controversy could have been answered two and a half years ago,” Fox News, Mar. 5, 2023: “A major controversy throughout the pandemic was surrounding the efficacy of face masks against the spread of COVID-19. However, a recent study supports that masks may have done little, if anything at all, to stop the spread of the virus. The study published by Cochrane Library, ‘Physical interventions to interrupt or reduce the spread of respiratory viruses,’ where esteemed researchers dug into the impact of physical interventions, like masks and hand washing, on the spread of COVID. Dr. Marty Makary joined Sunday Night in America to address this recent study and the vacillation on the effectiveness of masks since the start of the pandemic. … ‘What public health officials did is they hedged on the wrong side of the issue. They had the wrong hypothesis. And when overwhelmingly strong evidence came out time after time, sixty-five studies on masks, 160 studies on natural immunity. Study after study, they didn’t evolve their position.
