[2] Free Church of Scotland (Continuing) to Vacate Partick Free Church (Continuing) Properties in Glasgow and Return Properties to Free Church of Scotland after 24 January 2013 Court of Session Ruling

After a 24 January 2013 Court of Session ruling, the Free Church of Scotland (Continuing) (FCSC) will vacate the properties of the Partick Free Church (Continuing)and return the church properties to the Free Church of Scotland (FCS).

The FCSC issued the following statement on 28 January 2013:

“STATEMENT AGREED BY THE LEGAL ADVICE AND PROPERTY COMMITTEE: 28-01-13

“The Free Church of Scotland (Continuing) much regrets that, as a consequence of a decree by the Court of Session on an action raised by the congregation of Partick Free Church of Scotland, the congregation of Partick Free Church (Continuing) have been obliged to give up the Partick Free Church building which had been their place of worship since the division of 2000. The congregation have agreed to vacate the building on 31st January, having earlier vacated the manse.

“The FCS website carries a statement on this matter which leaves some points to be corrected. In particular, it implies that the legal action came about because of an unwillingness on the part of the Free Church (Continuing) congregation to negotiate on the basis of offers made by the other side. This is not the case, as has been made clear to the Partick FCS minister and the FCS Board of Trustees. The legal action was raised in 2008 without any meaningful attempt by the FCS side to reach a settlement by negotiation. Subsequent attempts to prevent the matter being decided at law were unsuccessful because of the refusal of the FCS congregation to negotiate in a way which recognised the needs of both congregations and the moral claim of the FCC congregation (the larger of the two parties in 2000) to a reasonable share of the property and funds. The demand was always made that the FCC drop from any defence at law. When the FCC dropped their defence, the most that the FCS side were prepared to concede was a half share of the funds in frozen bank accounts, equivalent to no more than 7 percent of the total value of congregational assets and property. It was this failure to negotiate in a true Christian spirit (unlike other congregations) that made it impossible for the FCC congregation to accept the arrangement in question. Their acceptance of the “ex gratia payment” now offered is on the understanding that this will  not be used for their own congregational purposes but will be applied to offset the legal defence costs incurred by the FCC denomination as a whole. This was made clear to the other side’s legal agents when the offer was accepted.

“It is an anomaly and a sadness to us in this whole matter that the congregation which has now taken possession of the Partick Free Church building is part of a denomination which in November 2010 adopted different principles and practices from those that had been held by the post-1900 Free Church and which are still maintained by the FCC and the congregation now ousted from the properties.

“It is a cause for thankfulness, however, that our congregation has obtained the use of Broomhill Community Church, 1 Norby Road, in the same general area as the Partick church, and that they expect to start worshipping there on Sabbath 3rd February. The move will inevitably cause a measure of dislocation but we earnestly pray that the congregation will be able to settle in quickly so that they can continue a faithful witness to the Gospel in the West-end of Glasgow.

The Free Church of Scotland (Continuing) was formed in 2000 by a minority of the FCS General Assembly (GA) after the majority of the FCS GA refused to carry out their biblical and confessional duties to address the alleged sexual misconduct of the then principal of Free Church College in Edinburgh, Scotland.

[3] Cumberland Presbyterian Church Organizes Church in Buenaventura, Colombia

The Cauca Valley Presbytery of the Cumberland Presbyterian Church (CPC) on 27 January 2013 organized the Emaus Mission (Fellowship) of Buenaventura, Colombia as an official CPC, thus making Emaus the second organized CPC church in this Colombian port city on the Pacific Ocean. Additionally, there are two CPC mission churches in Buenaventura.

In the same worship service, Euripides Moreno, pastor of Rios de Agua Viva Mission in Buenaventura, was licensed as a minister. Rito Gonzales and Mariano Torres were ordained to the ministry. The Rev. Gonzales is pastor of the Cucurrupí Mission in the Chocó and The Rev. Torres is pastor of the Los Angeles Mission in Buenaventura.
