[1] Polish Family in UK Appeal Order for Withdrawal of Food and Fluids from a Severely Disabled Patient
Following an online court hearing earlier in December, Mr. Justice Cohen agreed with the NHS doctors that, having suffered brain damage after his heart stopped for forty-five minutes on 6 November 2020, the middle-aged Polish man living in the West Country, who can be publicly identified only as “RS”, could survive “for up to five years or more”.
Since the heart attack, RS has been recovering, but the judge found that he would never recover beyond “a minimally conscious state”, and it was in his best interest for all life-sustaining treatment to be withdrawn, including nutrition and fluids.
In his judgment the judge found that RS “would not want to be kept alive in a state which provides him with no capacity to obtain any pleasure and which is so upsetting to his wife and children”. The judge concluded that it was not in RS’s best interests to be kept alive.
RS’s mother, who lives in Poland, has already spent most of her savings on legal fees, trying to save her son. Her fight to save her son’s life is supported by her children and grandchildren, although not by RS’s wife. The family has lodged an urgent appeal against the decision, which will be heard tomorrow.
In a controversial 2018 case, Lady Justice King was a member of both judicial panels which dismissed appeals by the parents of one-year-old Alfie Evans against the decision to withdraw his life support.
